Data Protection Case Against Businessman To Be Mentioned On July 29

A case in which a man has been charged with disclosing Personal data to a third party was today mentioned at the Milimani Law Court.

The defendant, Hatim Mohamed Tahir, is accused of providing confidential information to attorney Lynn Nganga, who is presently managing a civil lawsuit.

The incident reportedly occurred on September 19, 2023, at the Gigiri Courtyard, located in Nairobi’s Westlands Sub County.

During the proceedings, the defense counsel, Duncan Okatch, requested a media blackout, citing the defamation of his client.

Nevertheless, the presiding magistrate mandated a formal request for such an order.

The case is scheduled for a follow-up on July 29, where the court will deliberate on the hearing schedule and the media restriction plea.

Meanwhile, the Directorate of Criminal Investigations (DCI) has been granted a fortnight to present documentary proof.

The accused has been released on a cash bail of Ksh.100,000, with Magistrate R.M. Ndombi overseeing the case.

Additionally, the complainant has engaged the services of attorney Feisal Wakil for legal oversight.

A letter from the complainant indicates the appointment of Felix Otieno and Co. Advocates during their absence from Kenya.

“I am writing to inform you that due to my current absence in Kenya ,I have appointed the law firm of Felix Otieno and Co.Advocates to represent me in the ongoing criminal matter references under OB number 25/25/09/2013,” reads the letter

The case brings to light the critical aspects of Kenya’s Data Protection Act (2018), specifically Sections 72(b) and 73, which stress the protection of personal data and outline the obligations of those who handle such data.
