Petition to remove Said Chitembwe from office withdrawn

A petition seeking to oust High Court Judge Said Chitembwe has been withdrawn.

John Wangai and Stephen Ooko had petitioned the Judicial Service Commission (JSC) to remove Chitembwe from office but said their move lacked natural justice and constitutional merit.

“I wish to confirm that we have no complaint against the honorable Justice Said Chitembwe,” they said in a letter.

Chitwembwe, however, is not a free man yet since there is still one other pending petition before the JSC which was tabled by impeached Nairobi Governor Mike Sonko.

Sonko has accused Chitembwe of corruption.

The accusation was made via “sonko leaks”, a series of clips the ousted governor released on social media that so far has implicated well-known civil servants, including Nairobi Governor Anne Kananu.

Sonko claims Chitembwe accepted a handout to rule in favour of his removal from office, allegations the judge has termed as manipulation aimed at deriving false narrative.

Sonko had filed a petition to stop the swearing-in of Kananu but Chitembwe dismissed it.

“It is not a coincidence that the videos are released on the day of Anne Kananu’s swearing-in. He (Sonko) was angry the petition didn’t go through,” Chitembwe said.
