The Court of Appeal has temporarily suspended the four-month jail term against the Director of Criminal Investigations (DCI) George Kinoti.
This is after Kinoti filed an affidavit before the court on Tuesday complaining of harassment by businessman Jimi Wanjigi and his wife.
In the affidavit, Kinoti listed Wanjigi, Nzisa, Inspector General of Police Hillary Mutyambai, Director of Public Prosecutions (DPP) Noordin Haji, and Attorney General Paul Kihara as respondents.
“Being an application for stay of execution and/or conservatory order pending the lodging, hearing and determination of the intended appeal against the ruling and orders of the High Court of Kenya at Nairobi [Hon. A.C. Mrima, J] delivered at Nairobi on the 29th of November 2021, in Nairobi High Court Constitutional Petition No. 520 of 2017,” Kinoti said in the application.
Justices Imaana Laibuta, Fatuma Sichale and Mbogholi Msagha said, they will rule on Kinoti’s appeal, challenging his four-month jailing by the High Court in early April next year.
Kinoti was sentenced to four months in Kamiti prison on Thursday, November 18, for disobeying orders to release firearms belonging to Wanjigi.
His failure to present himself to the police for sentencing saw High Court issue a second arrest warrant on Tuesday, the same day he filed an affidavit.
