The 7-bench judge of the Supreme Court of Kenya made a unanimous decision on September 5 to uphold Preside-elect William Ruto’s win in the August 9 General Election.
The judges threw out Raila Odinga’s petition based on a lack of enough evidence when he sought to have the court nullify the presidential election results.
“We declare the election of the first respondent as President-elect to be valid…” Chief Justice Martha Koome ruled.
CJ Koome said the petitioners failed to prove beyond reasonable doubt that there was electoral malfeasance to warrant annulment.
“It is our finding that the declared President-Elect attained 50% +1 of all the votes cast in accordance with article 138.4 of the constitution,” she ruled.
President-elect Ruto will be sworn in on September 13, 2013, when he will take over the county leadership from the outgoing President Uhuru Kenyatta.
Ruto makes history by becoming the country’s first sitting Deputy President to succeed his boss in an election.
