Kakamega Senator Cleophas Malala surrendered to the police Monday evening after the National Cohesion and Integration Commission (NCIC) summoned him over the hate speech he made over the weekend.
Malala had vowed to disrupt the intended political convention at Bukhungu Stadium by COTU Secretary General Francis Atwoli where he would invite ODM boss Raila Odinga as Chief Guest.
He has since retracted saying that his statement was purely political and unintentional to incite anyone and rather took himself to Kakamega Central Police Station.
“He (Malala) clarified that what he said during the Maragoli Cultural Festival was a political statement, and that he does not intend to use violence or incite his followers into chaos during the rally,” said Kakamega Central Sub-County Police Commander David Kabena
The Kakamega senor in a clip shared on his Twitter account said that Odinga was not welcomed in the Luhya community and that in an event the gathering happened, they had to seek permission from him or his Party leader Amani National Congress (ANC) Musalia Mudavadi.
He said that Kakakamega County was his political bedroom and that no outsider was welcomed without his consent.
According to NCIC, his remarks were inflammatory.
“Kenya has no bedrooms and living rooms for any politician, and there is no space for locking out other politicians from any political side from any part of the country,” NCIC Chairperson Samuel Kobia said.
According to Kobia, Malala’s remarks welcomed him to the printed list onto the wall of shame.
“These summons also mean that he (Malala) is now a prime candidate for inclusion in the wall of shame; as well as facing the full force of the law.”
He has since withdrawn his remarks ahead of a rally which Atwoli said would mean to stamp ODM boss Odinga as the preferred presidential candidate for the Luhya people in the forthcoming general election.
