The High Court in Nairobi has reversed the acquittal of former Kipipiri Member of Parliament Amos Kimunya in a Ksh.60 million graft case.
In a ruling by Lady Justice Esther Maina, the former Majority Leader in the 12th Parliament was wrongly freed over lack of sufficient evidence.
“The court is satisfied that the prosecution had established a prima facie case against the accused persons,” Justice Esther Maina said.
Kimunya was accused of fraudulently transferring 25 acres of land in Nyandarua County which belongs to the government to a private company. He was then, the Minister for Lands and Housing.
He had been charged with abuse of office and conflict of interest.
The land had been set aside for the Ministry of Agriculture for seed multiplication and also acted as a farmers training centre.
Kimunya was acquitted alongside Lilian Njenga, former director of Land Adjudication and Settlement at the Ministry and Junghae Wainaina.
They were acquitted by anti-corruption chief magistrate Felix Kombo.
Justice Maina has ordered them to present themselves before chief magistrate Lawrence Mugambi on October 11, 2022 for directions on the defence hearing.
