The Director of Public Prosecution (DPP) Noordin Haji has dropped fraud charges against former Kenya Power Managing Director Ken Tarus.
Through senior assistant DPP Alexander Muteti, Haji said no offense had been revealed against Tarus after reviewing the evidence tendered so far.
Anti-corruption chief magistrate Elizabeth Juma marked the case against Taus as withdrawn under section 87(a) of the civil procedure code.
“For a court to decline such a request for discharge, it ought to consider whether it is an outright abuse of the court process and if there is any objection from other accused persons,” the magistrate said.
Tarus had been charged alongside eight others, who have not been spared and according to Haji, would pursue them for aiding in awarding contracts to companies that led to the payment of Ksh.159 million.
In July 2018, Haji ordered the arrest of the individuals over “procurement of defective transformers and irregularities in prequalifying 525 companies for labour and transport contracts.”
