Court deals Miguna major blow for his scheduled return to Kenya

Controversial lawyer Miguna Miguna will be forced to postpone his return trip to Kenya after High Court declined to lift red alerts that have impaired his return.

High Court judge Hedwig Ongudi dismissed the application on grounds that it cannot rely on speculation to grant the orders sought by Miguna.

“The case was filed prematurely without evidence and is therefore dismissed,” the court ruled.

The court has tasked controversial lawyer to prove the existence of a red alert in a petition that he listed senior government officials as respondents.

The officials are; Attorney-General Kihara Kariuki, Foreign Affairs Cabinet Secretary Raychelle Omamo, Kenya Civil Aviation Authority Director-General Gilbert Kibe, Kenya Airports Authority Acting Managing Director Alex Gitari and Interior Cabinet Secretary Fred Mating’i.

According to Miguna’s lawyer Dr. John Khaminwa, the alerts apply to two airlines Lufthansa German Airlines and Air France.

Miguna is scheduled to land back in the country on November 16, 2021 after he was f deported by the Kenyan government in March 2018.

He has already booked a flight from Toronto, Canada.

“For the avoidance of any doubt, I have used my Kenya Passport that Despot Uhuru Kenyatta perforated in February 2018 to book my flight to Kenya, scheduled to arrive in the morning of November 16, 2021 at the JKIA. Let no one claim that I have used any other passport,” Miguna tweeted on Friday.

Retired Chief Justice Willy Mutunga and Law Society of Kenya (LSK) have all joined forces to bring back Miguna.
