Court dismisses petition seeking to block Sonko from elective seats

Former Nairobi Governor Mike Sonko could rejoin a Mombasa gubernatorial race after High Court dismissed a petition that sought to bar candidates with integrity questions from contesting for any elective seats in Kenya.

Justices David Majanja, Chacha Mwita and Mugure Thande said the case touching on Sonko,  Kiambu Senate aspirant Karungo Thang’wa and MP Samuel Arama ( Nakuru Town West) were presented to court prematurely.

“Reprieve for Former Nairobi Governor Mike Sonko as a three-judge bench dismisses petition seeking to bar him from elective post,” Sonko wrote on his Twitter page.

In a ruling, the three-judge bench said the case was presented prematurely.

The case was touching on ex-Nairobi boss Sonko, Kiambu Senate aspirant Karungo Thang’wa and MP Samuel Arama of Nakuru Town West.

The Independent Electoral and Boundaries Commission (IEBC) lawyer Edwin Mukele, however, told the court that the Commission has no jurisdiction to deal with issues around the acceptance of Sonko’s candidature. According to him, the power to make the decision falls within the IEBC dispute committee.
